1. General provisions
1.1. These Terms of Service (the "Terms") are an agreement between the operator named in section 2 and the user on using the website fortumania.ru, the web app app.fortumania.ru and Fortumania's phone apps (together, the "Service").
1.2. The user accepts the Terms by ticking that they accept them when registering. The Service may be used without an account only in keeping with the Terms.
1.3. How the operator processes personal data is described in the Privacy Policy; the user consents to its processing separately, in the document "Consent to the processing of personal data".

3. What Fortumania is
3.1. Fortumania is an entertainment game simulator. It has no prizes in money or property, no cash-out, and no exchange of in-game items for money or for anything outside the Service.
3.2. The Service is under development: its features, games and rules may change, grow or be removed.
3.3. At the time of this version, the Service accepts no payments. If paid features appear, their terms will be set out in the Terms before they become available.
4. Age
4.1. The Service is for people aged 16 and over. By registering, the user confirms that they are 16 or older.
4.2. If the operator learns that someone under 16 has created an account, including from a complaint or from the user themselves, the operator blocks the account and deletes it together with its data.
5. The account
5.1. Registering takes an email address the user owns, a username and a password. The user gives a genuine address and does not share access to the account with anyone else.
5.2. The user is responsible for keeping their password safe. If the user believes someone else has gained access to their account, they change the password and tell the operator.
5.3. Usernames and display names must not be offensive or harmful, break the law, impersonate someone else or advertise. The Service checks names automatically and may refuse a name. If the operator considers a name offensive, harmful, unlawful or otherwise in breach of these rules, it may require the name to be changed, or change the username or display name itself without the user's agreement.
5.4. The user may delete their account at any time on the "Account" screen. Deletion cannot be undone: the account's data and all its in-game items are deleted with it.
6. In-game items
6.1. In-game items are virtual points, including in-game currency, game items and other in-game objects. They serve only for access to the gameplay within the Service.
6.2. In-game items are not money, property or property rights and have no monetary value. The operator pays no money for them and does not exchange them for money, goods, services or anything outside the Service.
6.3. In-game items cannot be withdrawn, sold, gifted, transferred to another user or exchanged, including outside the Service.
6.4. The operator may change how in-game items are earned and spent, and correct a balance where items were credited by mistake, through a fault or through a breach of the Terms.
7. Rules of conduct
The user may not:
- use software, bots, scripts or the Service's bugs to gain an advantage or in-game items;
- create several accounts to get around the Service's limits or gain an advantage;
- interfere with the Service, or access other users' accounts or data not meant for the user;
- sell, buy or transfer accounts or in-game items;
- break the law or the rights of other users and third parties.
8. The operator's rights
8.1. If the user breaks the Terms, the operator may limit their access to the Service, block or delete the account, and cancel in-game items obtained in breach.
8.2. The operator may change, suspend or end the Service or any part of it, including for updates and maintenance.
9. Intellectual property
The Service, its games, texts, images, software and design belong to the operator or are used by it lawfully. The user may use them only within the Service and for personal entertainment.
10. Liability
10.1. The Service is provided "as is". The operator tries to keep it running without faults, but does not guarantee that it will always be available or free of errors.
10.2. To the extent the law allows, the operator is not liable for losses caused by being unable to use the Service or by losing in-game items.
11. Changes to the Terms
The operator may change the Terms. A new version takes effect when published on this page, with its date at the top. By continuing to use the Service after publication, the user agrees to the new version; a user who does not agree may delete their account.
12. Disputes
12.1. The Terms are governed by the law of the Russian Federation.
12.2. Questions and claims go to contact@sparrowsoul.ru. The operator answers within 30 days. A dispute not settled this way goes to court under the law of the Russian Federation.
